Takaful and Life Protection Structure Evidence Checklist

October 29, 2026•3 min read

A protection product cannot be compared reliably from the labels “Takaful” and “life insurance” alone. The family needs the actual legal structure, benefits, exclusions, costs, investments, claims process and Shariah governance. This checklist creates that evidence file.

This is general information, not financial, legal, tax or Shariah advice. Product suitability and any religious conclusion require the complete current contract and appropriately qualified reviewers.

1. Quantify the loss being protected

Calculate debt, dependant income, education, final expenses, estate liquidity, business continuity and existing resources. Separate death, disability, severe illness and income interruption. A product comparison without a defined need can reward the largest benefit rather than the right cover.

2. Identify the exact legal product

Record the insurer or operator, policy number or quotation, legal owner, lives covered, payer, jurisdiction and contract version. Confirm whether the proposal is individual, group, employer, credit-linked or business cover.

3. Describe the risk-pool structure

For Takaful, obtain documents explaining participant contributions, the risk fund, operator role, fees, deficit support, surplus and claims. For conventional insurance, record the insurer's contractual promise, premium obligations and policyholder rights. Avoid comparing only marketing diagrams.

4. Verify regulatory status

Check the exact insurer, financial-services provider and representative using official FSCA registers. Record relevant licence categories and complaint routes. Regulatory authorisation does not establish Shariah compliance.

5. Obtain current Shariah evidence

For a Takaful proposal, request the named Shariah board or adviser, certificate or opinion, covered legal entity and product, governance standard, investment mandate, review date, exceptions and remedial process. A general brand statement is not product evidence.

6. Reconcile benefit definitions

Write the exact insured event, benefit formula, escalation, term and payment method for death, disability, severe illness or income protection. Compare own-occupation, nominated-occupation and any-occupation wording where relevant.

7. Test exclusions and waiting periods

Record exclusions, deferred periods, survival periods, pre-existing-condition treatment, hazardous activities, non-disclosure consequences and territorial limits. A lower price may reflect materially narrower cover.

8. Compare underwriting and evidence duties

Document medical, occupation, income and lifestyle evidence required at application and claim. Answer accurately and retain the submitted record. Confirm when revised terms, loadings or exclusions become binding.

9. Trace every cost

List contribution or premium, policy, operator, advice, administration, fund, investment and early-exit charges. Show commission and remuneration. Compare total expected rand cost under the same benefit, term and escalation assumptions.

10. Review the investment pool

Where contributions or reserves are invested, obtain the asset mandate, holdings or categories, managers, screening method, prohibited activities, purification and change process. Ask how liquidity and claims obligations affect the portfolio.

11. Understand surplus and deficit treatment

For Takaful, establish whether any surplus may be distributed, retained or applied to reserves, and whether the operator supplies a Qard or another form of deficit support. Do not treat a possible surplus as a guaranteed return.

12. Map claims administration

Record notification channels, required documents, assessment timeframes, disputes, ombud access and who supports the family. Test the process for incapacity or death when the usual account holder cannot act.

13. Coordinate ownership, beneficiaries and cessions

Policyholder, life assured, beneficiary, premium payer and cession affect control, tax, creditors, estate liquidity and succession. Obtain accepted nomination and cession evidence. A nomination should be reconciled with the will and Islamic estate plan.

14. Check employer and existing cover first

Obtain the employer fund and policy rules, insured salary, benefit formula, portability and termination events. Reconcile personal and group cover to avoid gaps and double counting.

15. Control replacement risk

Do not cancel existing protection until the replacement is issued, accepted, effective and checked against the approved comparison. Record new exclusions, waiting periods, underwriting changes, lost guarantees and cancellation evidence.
